Please read these Terms of Use carefully before accessing or using any part of the Volyhiy platform available at volyhiy.com. By accessing or using the platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the platform.
1. Definitions
The following terms apply throughout this document:
- Platform refers to the Volyhiy website, web application, and all associated services available at volyhiy.com.
- Company refers to Volyhiy, the operator of the Platform.
- User refers to any individual or entity accessing or using the Platform.
- Account refers to a registered user profile created to access Platform features.
- Content refers to any text, video, audio, graphics, documents, or other materials made available through the Platform.
- Session refers to any live or recorded webinar, workshop, or educational broadcast hosted on the Platform.
2. Eligibility
You must be at least 18 years of age to create an Account or use the Platform independently. Users between the ages of 13 and 17 may use the Platform only with verifiable consent and supervision of a parent or legal guardian. By using the Platform, you represent and warrant that you meet the applicable eligibility requirements.
The Platform is intended for individuals seeking educational content related to entrepreneurship and business development. Use for any other purpose not aligned with this scope is subject to the Company's discretion and may result in access restriction.
3. Account Registration and Security
3.1 Registration
Certain features of the Platform require you to create an Account. You agree to provide accurate, current, and complete information during registration and to keep your information updated at all times. Providing false or misleading information may result in immediate termination of your Account.
3.2 Account Credentials
You are solely responsible for maintaining the confidentiality of your login credentials. You must not share your credentials with any third party. You agree to notify the Company immediately at info@volyhiy.com if you become aware of any unauthorised access to or use of your Account.
3.3 Account Responsibility
All activity conducted through your Account is your responsibility, whether or not authorised by you. The Company is not liable for any loss or damage arising from your failure to protect your Account credentials.
4. Permitted Use
You may use the Platform solely for lawful, personal, and non-commercial educational purposes, unless you hold a valid written agreement with the Company permitting commercial use. Specifically, you agree to:
- Access Sessions and Content only for personal learning and development;
- Comply with all applicable laws and regulations when using the Platform;
- Respect the intellectual property rights of the Company and other users;
- Engage respectfully with other participants during live Sessions.
5. Prohibited Conduct
You must not engage in any of the following while using the Platform:
- Recording, reproducing, distributing, or publicly displaying any Session or Content without prior written authorisation from the Company;
- Uploading, transmitting, or sharing any material that is unlawful, harmful, defamatory, obscene, or otherwise objectionable;
- Attempting to gain unauthorised access to any part of the Platform, its servers, or connected systems;
- Using automated tools, bots, scrapers, or similar technologies to extract data from the Platform;
- Impersonating any person or entity or misrepresenting your affiliation with any person or entity;
- Interfering with or disrupting the integrity, performance, or availability of the Platform;
- Engaging in any conduct that could damage the reputation of the Company or other users;
- Reselling, sublicensing, or otherwise commercialising access to the Platform or its Content without authorisation.
6. Intellectual Property
6.1 Ownership
All Content, branding, design elements, software, and materials available on the Platform are the exclusive property of the Company or its licensors. These are protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership rights to you.
6.2 Limited Licence
The Company grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform and its Content solely for your personal educational purposes as permitted under these Terms. This licence does not include the right to copy, modify, distribute, sell, or create derivative works from any Content.
6.3 User Submissions
If you submit, post, or share any content through the Platform, including questions, comments, or feedback during Sessions, you grant the Company a worldwide, royalty-free, perpetual licence to use, reproduce, and display such submissions for operational and promotional purposes. You represent that you hold all necessary rights to grant this licence.
7. Sessions and Scheduling
7.1 Session Availability
The Company reserves the right to schedule, reschedule, cancel, or modify any Session at any time. Where a Session is cancelled by the Company, registered participants will be notified and provided with available alternatives or applicable remedies at the Company's discretion.
7.2 Participation Standards
During live Sessions, participants are expected to conduct themselves professionally and respectfully. The Company reserves the right to remove any participant from a Session without notice if their conduct is deemed disruptive, inappropriate, or in violation of these Terms.
7.3 Recordings
Sessions may be recorded by the Company for educational, archival, or promotional purposes. By participating in a Session, you acknowledge and consent to such recording. You must not record any Session independently without the Company's explicit written permission.
8. Payments and Refunds
8.1 Fees
Access to certain Sessions or features may require payment of applicable fees. All fees are displayed on the Platform prior to purchase. The Company reserves the right to change pricing at any time, with changes taking effect upon posting to the Platform.
8.2 Payment Processing
Payments are processed through third-party payment providers. The Company does not store your full payment card details. By completing a purchase, you agree to the terms of the applicable payment processor.
8.3 Refund Policy
Refund eligibility is determined on a case-by-case basis and communicated at the point of purchase or upon request. To request a refund, contact the Company at info@volyhiy.com. The Company is not obligated to provide refunds where a Session has already been accessed or attended.
9. Third-Party Links and Services
The Platform may contain links to third-party websites, tools, or services. These are provided for convenience only. The Company does not endorse, control, or accept responsibility for the content, privacy practices, or terms of any third-party service. Your use of third-party services is entirely at your own risk and subject to those parties' terms.
10. Disclaimer of Warranties
The Platform and all Content are provided on an as is and as available basis without warranties of any kind, whether express or implied. The Company does not warrant that the Platform will be uninterrupted, error-free, secure, or free of harmful components. Educational Content is provided for informational purposes only and does not constitute professional business, legal, financial, or investment advice.
11. Limitation of Liability
To the fullest extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, including loss of data, revenue, or business opportunity. The Company's total aggregate liability for any claim arising under these Terms shall not exceed the total amount paid by you to the Company in the twelve months preceding the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless the Company and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.
13. Termination
The Company reserves the right to suspend or permanently terminate your Account and access to the Platform at any time, with or without notice, if you violate these Terms or engage in conduct the Company considers harmful to the Platform, other users, or the Company itself. Upon termination, your right to access the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination will continue to apply.
14. Modifications to These Terms
The Company may update these Terms at any time. When changes are made, the updated Terms will be posted on this page with a revised date. Your continued use of the Platform after the posting of updated Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must discontinue use of the Platform.
